TCPA Policy and Consent Practices

1. Purpose and Scope

RefiGuide.org (“RefiGuide,” “we,” “us”) operates an advertising marketplace and lead-generation platform connecting consumers with licensed mortgage providers. We are not a lender, broker, or financial institution, and we do not originate or underwrite loans.

This policy describes how we collect, record, honor, and revoke consumer consent to receive telephone calls and text messages under the Telephone Consumer Protection Act (47 U.S.C. § 227), its implementing regulations at 47 C.F.R. § 64.1200, the FTC’s Telemarketing Sales Rule, and applicable state telemarketing statutes.

This policy applies to RefiGuide, to any contractor acting on our behalf, and to the licensed mortgage providers and marketing partners who receive consumer information through our platform.

2. Consent Standard

We do not place marketing calls or send marketing texts to any consumer absent prior express written consent.

Consent collected through RefiGuide forms meets the following standards:

  • Clear and conspicuous disclosure. Consent language appears in legible type immediately adjacent to the submission control, not buried in linked terms.
  • Affirmative action required. Consent is obtained through an unchecked checkbox or an equivalent affirmative act. We do not use pre-checked boxes.
  • Not a condition of service. Consumers are informed that consent is not required to obtain rate quotes or use our comparison service.
  • Seller identification. Our disclosure identifies the parties who may contact the consumer, either by name or through a conspicuously linked, dated list of participating providers.
  • Technology disclosure. Consent expressly covers automatic telephone dialing systems, artificial or prerecorded voice messages, and SMS/MMS.
  • Electronic signature. Consent is captured and retained in a form satisfying the E-SIGN Act.

3. Consent Disclosure Language

The following disclosure appears on RefiGuide rate request and lead capture forms:

By checking this box and clicking “[Submit / Get Quotes],” I provide my express written consent for RefiGuide.org and the mortgage providers identified on this list to contact me at the telephone number I provided — including my wireless number — using automated telephone dialing systems, artificial or prerecorded voice messages, and SMS text messages, for marketing purposes relating to mortgage, refinance, and home equity products.

I understand that consent is not a condition of purchasing any product or service, and that I may revoke consent at any time by any reasonable method, including by replying STOP to any text, telling a caller to stop, or contacting RefiGuide.

Message and data rates may apply. Message frequency varies. I also agree to RefiGuide’s Terms of Use and Privacy Policy.

Participating providers are identified on our Marketing Partners page, which is linked directly from each consent disclosure and is maintained with the date of last revision.

4. Revoking Consent

You may revoke consent at any time, by any reasonable method. We do not require a specific form of words or a particular channel.

Methods we honor include:

  • Replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or REVOKE to any text message
  • Telling any caller that you no longer wish to be contacted
  • Using any opt-out mechanism in a prerecorded message
  • Emailing [OPT-OUT EMAIL]
  • Calling 800-278-7010
  • Writing to RefiGuide.org, 4809 Clairemont Dr #C, San Diego, CA 92117

We process revocation requests within 10 business days of receipt, as required by FCC rules effective April 11, 2025, and we transmit revocation notices to any marketing partner that received your information.

Important: revoking consent with RefiGuide stops contact from RefiGuide and from partners we notify. If you provided your information directly to a lender, or through another website, you may need to revoke consent with that party separately.

5. Do Not Call Compliance

RefiGuide maintains an internal Do Not Call list and honors requests indefinitely. We also scrub against the National Do Not Call Registry and applicable state registries.

Consumers who provide express written consent may be contacted notwithstanding registry listing, consistent with the established business relationship and consent provisions of the TSR and FCC rules — until consent is revoked.

6. Calling Hours

Calls and texts are placed only between 8:00 a.m. and 9:00 p.m. in the consumer’s local time zone, determined by area code or, where available, verified address. Several states impose narrower windows, and we observe the more restrictive standard where applicable. (RefiGuide.org does not presently do outbound calls)

7. Identification

Callers acting on behalf of RefiGuide or its partners identify themselves by name and on whose behalf they are calling at the outset of each call, and provide a telephone number at which that party may be reached.

8. Record Retention

For each consent obtained, RefiGuide retains:

  • The exact disclosure language displayed to the consumer
  • A screenshot or rendered capture of the form as presented
  • Date and time stamp of submission
  • IP address and device identifiers
  • The URL at which consent was given
  • All fields submitted, including the telephone number
  • The identity of parties covered by the consent at the time it was given
  • Any subsequent revocation, with date and method

Records are retained for a minimum of five years and furnished to partners and regulators on request.

9. Marketing Partner Requirements

Mortgage providers and marketing partners receiving consumer information through RefiGuide are contractually required to:

  • Maintain TCPA compliance and all applicable state and federal licensing
  • Honor revocation requests within 10 business days and transmit them back to RefiGuide
  • Maintain their own internal Do Not Call lists
  • Observe calling hour restrictions
  • Not resell, transfer, or share consumer information with parties not covered by the original consent
  • Identify themselves accurately on every contact
  • Indemnify RefiGuide against claims arising from their contact practices

We terminate partners who fail to meet these obligations.

10. State Law

Several states impose telemarketing requirements stricter than federal law, including Florida (Florida Telephone Solicitation Act), Maryland (Stop the Spam Calls Act), Oklahoma, and Washington. Where state law is more restrictive, RefiGuide and its partners observe the more restrictive standard.

11. Complaints

If you believe you have received a call or text in violation of this policy or applicable law, contact us at 800-278-7010. Please include the date, time, telephone number contacted, and the identity of the caller if known.

We investigate all complaints, add the number to our internal Do Not Call list immediately upon receipt, and notify any partner identified.

12. Changes to This Policy

We may update this policy as law and practice change. Material changes will be posted here with a revised date.
